Litigation involving community associations is unlike other litigation. This course will review the unique issues and requirements that arise in litigation involving community associations, such as requirements for pre-suit mediation and arbitration demands, the rules of procedure applicable to community associations, defenses available to community associations, and ethical considerations when handling litigation involving community associations. Highlights will include the statutory compliance with pre-suit demands, derivative actions by members, remedies and obligations that are statutory, and the impact of the governing documents on claims and defenses in litigation.
