This course will provide updates on two significant issues facing Florida's beaches: (1) public access via "customary use"; and (2) conditions for Federal nourishment projects. First, an overview of the customary use doctrine will be provided. The controversial State legislation (F.S. Sec. 163.035) and well-publicized Walton County litigation will be summarized, with a focus on their implications moving forward. Second, the status of Federal nourishment projects across the State will be addressed. Specifically, U.S. Army Corps requirements for local governments (sponsors) -- most notably certifying perpetual public access -- will be discussed. Although this course focuses on coastal property rights, anyone interested in the future of our State's beautiful beaches will benefit from its content.
