This webinar is divided into two parts, the first tackling the basics of Elder/Probate law for appellate practitioners, and the second discussing important aspects of appellate law for trial lawyers who specialize in Elder/Probate law. Part 1 of the program will provide appellate and elder law attorneys with insight into the growing complexities of elder law, with a special focus on issues that are increasingly becoming the focus of appellate litigation. These issues include are not limited to: Medicaid applications, guardianships, probate litigation, unique probate rules of procedure vs “regular” appellate rules, the difference between a final and non-final order in elder law, and recent changes in Rule 9.170. During Part 2 of the program, presenters will provide practical tips for probate and elder law attorneys about the appellate process. Practitioners will get information about preserving matters for appeal and taking matters up on appeal. The speakers will discuss what matters are appealable and what matters require discretionary petitions for extraordinary writs. Finally, attendees will get an overview of the appellate process and what happens when a matter is ruled upon by the appellate court.
